Pennsylvania - Restriction of Emergency Authority
I am exploring possibilities of putting a referendum for a binding resolution, in the Commonwealth of Pennsylvania, to be voted upon by the citizens of Pennsylvania. The purpose of this resolution is to remove any and all authority during any declared emergency to impose mandatory lock-downs, stay at home orders, business closures or restrictions, revocation or suspension of licenses, restrictions on the legal sale or purchase of firearms and ammunitions and the right of the people to congregate, travel and go about their normal lives, from the governor, the lieutenant governor, the legislature and any appointed government agency or employee, bureau, task force, or entity shall not and may not under any circumstance, nor proclaimed emergency impose or direct to be imposed such restrictions or enact any decree, order, or proclamation causing the same to be enacted or enforced.
The government, or any agency or representative, may not and shall not use any declaration of emergency to revoke, suspend or inhibit any and all rights and freedoms granted and protected by the constitution of this Commonwealth and the United States.
The role of the state, county and local government and health and emergency services shall be to advise, assist and recommend voluntary procedures during an emergency. To facilitate emergency response and to coordinate emergency services with the federal government.
We the People of the Commonwealth of Pennsylvania, due to gross abuse of emergency authority and deliberate deception during the Covid-19 pandemic, having lost all faith and trust in the government and it’s agencies to wield such power, do hereby reserve onto our individual selves the freedom to respond in a manner of our own individual choice.
I am not a lawyer. So I do not know the feasibility of getting this done.
Does PA law now currently allow for such a petition to get something on the ballot? If so, can it be in form of a binding resolution that the legislature must abide by and the governor cannot veto? If so what is proper way to get a petition presented and the requirements.. Please help if you can so we can get this done.
